Spring-Green Lawn Care Corp. and its parents, affiliates and designees (“we” or “us”) have developed this privacy policy (“Privacy Policy”) to explain our practices in connection with the following digital services (collectively, the “Digital Services”): (i) this website (www.spring-green.com) and other websites (including, www.spring-greenfranchise.com) that we manage or own (individually, the “Site” and collectively the “Sites”), (ii) any software applications made available to us for use on or through computer and mobile devices (the “App(s)”), and (iii) any other digital communications or content that we may publish that link to this Privacy Policy, including advertisements that we may place on third-party websites such as social media pages. This Privacy Policy does not apply to the privacy practices of websites or other services operated by third parties. Once you leave the Site via a link or access a third-party application or widget, we recommend that you review the applicable privacy policy of that third party to determine how it will handle any Personal Information (defined below) it collects from you. Certain of our affiliates may have their own websites, and in that case, the privacy policy of that website shall govern such other website and will supersede this Privacy Policy.

We believe that our practices allow us to provide great offers to you, without unnecessary use or disclosure of your information. By accessing or using any of the Digital Services, you are agreeing to this Privacy Policy. If you do not agree with this Privacy Policy, please do not access or use the Digital Services or provide us with any of your Personal Information.

Information We Collect and How We Collect It

When you visit our Sites, our web server automatically recognizes only your domain name, but not your email address unless you have a static IP address, which may be recorded in our server logs. We collect the domain name and email address (where possible) of visitors to our web page and aggregate information on what pages those visitors access or visit. This information is used to improve the content of our web page.

Information you volunteer on our Sites, such as survey information and/or site registrations or any personally identifiable information  such as name, property address, mailing address, telephone number and email address (whether manually entered by you or identified by us through use of a promotional reference number) (“Personal Information”), may be used to provide you with information on new products and services or upcoming events or to provide you with updates to our Sites. If you request information from us, we may contact you to discuss the information provided or to provide the information to you. If you would rather not receive this information from us in the future, please contact us through one of the channels identified in the “Opt-Out” section below.

Personal Information might include but is not limited to: (a) contact information (e.g., name, address, phone number, date of birth and email address); (b) credit card information (e.g., credit card number); (c) information regarding certain of your preferences related to us or the Digital Services; and/or (d) information regarding how you became aware of the Digital Services. Personal Information also includes information about your activities (such as information about your activity within the Digital Services, and demographic information, gender, geographic area, and/or your lawn preferences) when any of this information is linked to Personal Information that identifies you. We may combine Personal Information that we have collected offline with Personal Information we collect online, or we may combine information we get from third parties with information we already have.

In addition to the Personal Information that we collect directly from your use of any of the Digital Services, we may have access to other Personal Information from third parties. For example, we may obtain Personal Information from research and analytic companies, marketing partners, public databases, payment processors, mobile carriers, third-party login authentication, and similar third-party sources. We may also receive your Personal Information from other sources, such as people that you are in some way connected with, or our own affiliates and representatives.

We may also collect and store statistics and other non-personal information about your online activities on an aggregate basis (“Non-Personal Information”). Non-Personal Information is information that we collect about a group of users where the individual users are not personally identifiable or from which individual identities are removed. It includes non-personal information such as browser type, system type, page hits, number of visits, web pages viewed and the length of visits to the Sites. We may tie Personal Information to your IP address for purposes of providing relevant information on products, services and offers to you when you revisit any of the Sites. Non-Personal Information is not considered Personal Information as long as it will not directly or indirectly reveal your identity. However, if we combine or connect your Non-Personal Information with your Personal Information so that it can directly or indirectly identify you, we treat the combined data as Personal Information which will be used in accordance with this Privacy Policy.

Information We Collect Through Automatic Data Collection Technologies

We may collect Non-Personal Information passively using technologies such as cookies. We use cookies to assign a unique identification to your computer. Cookies are files that your browser places on your computer’s hard drive, which we may use to learn how you arrived at the Site. Cookies are also used to save and retrieve your email address, password and preferences so you do not have to re-enter this information each time you visit the Site. In some cases, we may track or collect information about your use of the Sites by the numeric address assigned to the computer you are using (your IP address) or by the URLs that you come from or leave to. These methods also allow us to resolve server problems or administer the Sites.

You may refuse to accept browser cookies by activating the appropriate settings on your browser. However, if you select this setting, you may be unable to access certain parts of our Sites. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Sites.

For reasons such as improving your experience at our Sites or personalizing our Sites to you (for example, providing better product and service recommendations or special offers or service recommendations that we think will interest you), we may supplement the information that you provide with information from third parties.

Some content on the Sites, including advertisements, are served by third parties, including advertisers, ad networks, content providers and application providers. Such third parties may use cookies to collect information about you when you use our website. The information they collect may be associated with your Personal Information, or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. This may be used to provide you with internet-based advertising or other targeted content. We do not control these third parties’ tracking technologies or use of cookies. If you have questions about how an advertisement or other targeted content is provided you should contact the responsible provider directly.

Credit Cards

In order to retain our services, you will need to give us certain personal information (name, email address, telephone number, address(s), credit card type, number, expiration, and CVV2 value). We store your contact information in our order entry system. We do not store your credit card details. In fact, your credit card information never passes through our site—it is captured directly by our designated third-party payment gateway. Anyone involved with the processing, transmission, or storage of card data must comply with the Payment Card Industry Data Security Standards (PCI DSS).

Children

We will not knowingly collect any “personal information”, as defined by the U.S. Children’s Online Privacy Protection ACT (“COPPA”), from children 17 years of age or younger. When you disclose Personal Information on the Sites, you are representing to us that you are 18 years of age or older. If a person 17 years of age or younger has provided Personal Information to us, a parent or guardian should contact us at service@spring-green.com so that we can remove such Personal Information from our active databases. We will not be liable for any collection of children “personal information” or failure to comply with COPPA by a third party. Children can access many parts of the Sites and its content and use many of its features without providing us with “personal information.” We use certain technologies, such as cookies, to automatically collect information from our users (including children) when they visit or use the Sites.

 

How We Use And Disclose Your Information

We are the sole owners of all information and data collected through our Digital Services. We work with a variety of partners who provide a comprehensive array of programs and lawn care–related services that enhance and enrich the lives of homeowners. We may provide certain of your Personal Information to lawn care–industry partners such as big box stores or other types of lawn care–related service providers who may provide you with advertisements or offers for products and services we and they believe may interest you. If you do not want us to provide Personal Information to these lawn care–industry partners, you can opt-out by contacting us through one of the channels identified in the “Opt-Out” section below.

Your Personal Information will be available to us and our agents, affiliates, representatives, franchisees, and designees (collectively, the “Spring-Green Parties”). By submitting Personal Information, you grant to the Spring-Green Parties a license to use such Personal Information for the purposes described in this Privacy Policy. Personal Information may be used in the manners described below at the time you voluntarily provide such Personal Information.

We may use your Personal Information for internal business purposes, including without limitation, to help us improve the content and functionality of the Digital Services, to customize your experience with us, to better understand our users, to protect against, identify or address wrongdoing, to enforce our Terms of Use, to manage your account and provide you with customer service, and to generally manage the Digital Services and our business. In addition, the Spring-Green Parties may also use your Personal Information, alone or in combination with the information submitted by other users, to improve the Sites’ navigation or infrastructure, in internal marketing analyses or reviews, and for other administrative purposes.

In all cases, however, any Spring-Green Party that has access to Personal Information or Non-Personal Information is required to use and protect such information in a manner consistent with this Privacy Policy and to use such information only to carry out the activities or services they are performing for you or for us.

We may contact you about your account or purchases. We might also contact you about this Privacy Policy or our website Terms of Use.

If you register with us, we’ll enroll you in our email newsletter. With your prior express written consent at sign up, we may also send you SMS text messages. We may also use your Personal Information to identify you as a customer. Once we do this, we may tailor ads for you on other websites and social platforms by matching your activities or information collected with those collected on third party sites. We do this by sharing information like your email address with third parties.

Unless you notify us to the contrary, any Spring-Green Party may use your Personal Information in the future to contact you for marketing and advertising purposes, including without limitation, to tell you about new features, updates, products, services, promotions or special offers we think you might find interesting, to inform you about services or events we believe might be of interest to you, and to develop promotional or marketing materials and provide those materials to you. If you do not wish to receive these types of communications or allow a Spring-Green Party to use your Personal Information in such a manner, please contact us in the manner identified in the “Opt-Out” section below.

We may transfer your Personal Information to a third party who directly or indirectly acquires any ownership interest in us or any of our affiliates, or acquires the Digital Services, whether such acquisition is by way of merger, consolidation, or purchase of all or a substantial portion of our assets.

Your privacy is very important to us. However, due to the existing legal and technical environment, we cannot ensure that your Personal Information will not be disclosed to third parties in ways not described in this Privacy Policy. For example, we may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Additionally, we can (and you authorize us to) disclose any information about you to private entities, law enforcement or other government officials that we, in our sole discretion, believe is required: (a) by law; (b) to protect and/or defend our property or other legal rights; and/or (c) to protect the personal safety, or property or other legal rights of others. In any event, we cannot and do not guarantee that our franchisees will follow the terms of this Privacy Policy. Therefore, if you provide information to any of these parties, such information will not be subject to the terms of this Privacy Policy.

Accessing and Correcting Your Information

You may review, change, or request the deletion of your Personal Information and preferences at any time by sending us an email to info@spring-green.com, calling us at (630) 352-3102 or writing to us at Spring Green Lawn Care Corp., 11909 Spaulding School Drive, Plainfield, IL, 60585. We will then take all reasonable efforts to correct or remove your Personal Information from our active database. We may require you to provide us with reasonable evidence to verify that the person making a request to review, change, or delete information is the person about whom we’ve collected the information.

Opt-Out

If you choose to opt-out from allowing the Spring-Green Parties to use your Personal Information in the future to provide you with special offers/marketing communications, simply contact us directly at service@spring-green.com, Spring-Green Lawn Care Corp., 11909 Spaulding School Drive, Plainfield, Illinois 60585, telephone (844) 777-8608. Additionally, “opt-out” instructions are contained in each special offer/marketing communication sent to you. Upon receipt and processing of an “opt-out” request, we will, within a commercially reasonable amount of time, remove your information from any listings used to provide you with special offers/marketing communications from Spring-Green Parties in the future. Please note that we may occasionally contact you for administrative purposes (including, without limitation, billing, as mandated by law for applications of product, newsletters or customer surveys) even if you unsubscribe from our email list.

U.S. Postal Mail – Do Not Mail List

We maintain an internal “do not mail” list of existing and prospective residential customers who request not to receive any marketing materials via U.S. postal mail. This policy only applies to marketing materials. You will still receive billing statements, legal notices, product updates and other similar correspondence. To be placed on our “do not mail” list, you must contact us at directly at service@spring-green.com, Spring-Green Lawn Care Corp., 11909 Spaulding School Drive, Plainfield, Illinois 60585, telephone (844) 777-8608 and specify each individual member of the household and each associated address to be added to the “do not mail” list. We generally process these requests within 30 days. However, because our mailings are processed and scheduled for delivery well in advance, you may continue to receive additional offers for some time after your request to us to be added to the “do not mail” list. In addition, we may direct marketing mail to certain neighborhoods or ZIP codes, addressed to “Homeowner,” “Resident” or similar. These offerings are delivered to all homes in a neighborhood or ZIP code. You may continue to receive this type of marketing mail even if you opt-out of receiving marketing related postal mailings from us. We may modify this procedure or discontinue the “do not mail” list at any time.

Remarketing

We use remarketing tracking cookies and conversion pixels from vendors such as Google, Facebook, Twitter, and LinkedIn to present special offers to you for our products or services over the Google Content Network and via social networks. This means you may see an ad for one of our products or services as a result of visiting our Sites. In addition, Spring-Green uses custom audiences based on emails of subscribers and customers. This allows us to present special offers for our products and services to you via Facebook. The third parties with whom we share this Personal Information or Non-Personal Information may use it for their own purposes and in accordance with their own policies. We are not responsible for their actions.

Data Security

We take every reasonable precaution to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. When our registration/order form asks you for Personal Information, that information may be encrypted and is protected with industry-standard encryption software - SSL. If we do so, we will notify you at that time if such encryption is available. Please note, however, that no data security measures can be guaranteed to be completely effective, and we cannot guarantee the safety or security of your information. You understand that your use of the Digital Services and submission of information to us is at your own risk.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information. If you are a resident of Virginia, you may have certain additional data protection rights regarding the access, correction, deletion, processing, storage, portability, transfer, and restriction of your Personal Information under the Virginia Consumer Data Protection Act (“VCDPA”), including the right to:


  • request access to your Personal Information;
  • request erasure of your Personal Information; and
  • opt-out of the sale or disclosure to third parties.


To exercise any of these rights, please contact us at directly at info@spring-green.com.  We may require you or your authorized representative to verify your request by providing us with additional information, including providing us with information to verify your identity before disclosing any Personal Information to you. This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. You may only submit a request to access your Personal Information twice within a 12-month period. You do not need to create an account with us to submit a request to access or erase your Personal Information.


We try to respond to all legitimate requests within 45 days. Occasionally it could take us longer than 45 days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated. We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 


We will not discriminate against you for exercising any of your rights under any applicable state laws. Unless permitted by the applicable state law(s), we will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; (iii) provide you a different level or quality of goods or services; or (iv) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.  However, we may offer you certain financial incentives permitted by the applicable state laws that can result in different prices, rates, or quality levels. Any financial incentive we offer that is permitted under the applicable state laws will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.


During the preceding 12 months, we have collected each of the categories of Personal Information we describe in the Privacy Policy above, but we have not sold Personal Information to third parties.


If you are under the age of 18, you may request and obtain removal of any content or information that is publicly posted through any of the Digital Services. To remove this content, please email us at info@spring-green.com and indicate in your email the exact specific information you would like removed.  Please know that this removal does not mean that all copies will be destroyed, we may retain copies for various reasons, including to comply with law.

 

Changes to our Privacy Policy

This Privacy Policy may change from time to time. If we make a material change to how we treat our users’ Personal Information, we will notify you by email to the email address on file for your account and/or through a notice on the Sites’ home page(s). The date the Privacy Policy was last revised is identified at the top of the Privacy Policy. You are responsible for ensuring that we have an up-to-date, active, and deliverable email address for you. Your continued use of the Digital Services after we make changes is deemed to be acceptance of those changes.

United States Jurisdiction

We are headquartered in the United States and the Digital Services are exclusively for use in the United States and by United States residents. You consent to the transfer, storage and processing of all Personal Information we collect in the United States.
